Fish Ai Identifier – Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of the Fish AI Identifier mobile application, related websites, and services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who we are The Service is operated by HEBE VISION INC SRL (“we,” “us,” “our”).
Eligibility You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority where you live, you may use the Service only with a parent or legal guardian’s permission.
License and permitted use We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.
Acceptable use You agree not to:
misuse the Service, attempt to access it using automated means not provided by us, or interfere with its normal operation;
reverse engineer, decompile, disassemble, or attempt to extract source code (except to the extent this restriction is prohibited by law);
use the Service to violate any law or third-party rights (including privacy, intellectual property, or publicity rights);
upload or submit content you do not have the right to use.
AI outputs and identification disclaimer (important) The Service may provide species identification and other information based on images and inputs you provide. Outputs are generated by automated systems and may be inaccurate, incomplete, or inappropriate for your situation. The Service is provided for informational purposes only and is not professional advice. Do not rely on the Service for safety-critical decisions (including consuming fish, medical decisions, navigation or boating safety, or compliance with fishing regulations). Always verify identification and applicable local laws with qualified sources.
Your content You may be able to upload images and other content (“User Content”). You retain ownership of your User Content. You grant HEBE VISION INC SRL a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process your User Content solely to operate, maintain, and improve the Service (including running it through machine-learning models), and to enforce these Terms. Where required by law, we will obtain any necessary consent for such processing. You are responsible for your User Content and represent that you have all rights needed to provide it.
Subscriptions, paid features, and trials (if offered) The Service may offer paid subscriptions or one-time purchases (“Paid Features”). Prices, billing periods, and benefits are shown at purchase time and may vary by platform or region.
Billing: If you purchase through Apple’s App Store or Google Play, the platform processes payments and controls refunds. Your subscription automatically renews unless canceled at least 24 hours before the end of the current period.
Trials or Promotions: If a free trial or promotional pricing is offered, it will convert to a paid subscription unless you cancel before the trial ends.
Manage or Cancellation: You can manage and cancel subscriptions in your App Store or Google Play account settings.
Refunds Refunds (if any) are handled by the store where you purchased (Apple App Store or Google Play) and are subject to their policies. HEBE VISION INC SRL generally cannot issue refunds for purchases made through third-party platforms.
Third-party services The Service may integrate third-party services (for example, analytics, hosting, or paywall and subscription providers). Your use of those services may be subject to their separate terms and policies. HEBE VISION INC SRL is not responsible for third-party services.
Privacy Our collection and use of personal information is described in our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy controls.
Intellectual property The Service, including its software, design, text, graphics, logos, and trademarks, is owned by HEBE VISION INC SRL or its licensors and is protected by applicable intellectual property laws. Except for the limited license granted in Section 3, no rights are granted to you.
Changes to the Service HEBE VISION INC SRL may modify, suspend, or discontinue the Service (in whole or in part) at any time. We are not liable for any modification, suspension, or discontinuation.
Termination HEBE VISION INC SRL may suspend or terminate your access to the Service if we reasonably believe you violated these Terms or if necessary to protect the Service, users, or third parties. You may stop using the Service at any time.
Disclaimer of warranties THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEBE VISION INC SRL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.
Limitation of liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEBE VISION INC SRL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEBE VISION INC SRL’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR US$50 IF YOU PAID NOTHING. Some jurisdictions do not allow certain limitations; in those jurisdictions, liability will be limited to the greatest extent permitted by law.
Indemnity To the extent permitted by law, you agree to defend, indemnify, and hold harmless HEBE VISION INC SRL from and against claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms.
Governing law These Terms are governed by the laws of the jurisdiction where HEBE VISION INC SRL is established, without regard to conflict-of-law rules. Where required by law, you may also have the right to bring claims in your country of residence.
Changes to these Terms HEBE VISION INC SRL may update these Terms from time to time. If material changes are made, notice will be provided within the app or by other reasonable means. Continued use of the Service after the effective date of updated Terms means you accept the updated Terms.
